These Terms of Service ("Terms") govern your access to and use of the MUAH mobile and web application (the "App") and this website (the "Site"), together the "Services," operated by MUAH ("MUAH," "we," "us," or "our"). By creating an account, browsing artist profiles, booking an appointment, or otherwise using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Who Can Use MUAH

You must be at least 18 years old, or the age of majority where you live, to create an account, book an appointment, or register as an artist. If you're between 13 and 17, you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The Services are not directed to children under 13 — see our Privacy Policy for more.

2. Your Account

You're responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that happens under your account. Let us know right away if you believe your account has been accessed without your permission.

You can sign up as a client looking to book makeup and hair services, or as an artist offering those services. Some features — like booking, messaging, and joining Creative Circles — require a registered account.

3. Location Services

The App asks for permission to access your device's location so it can show you makeup and hair artists near you on the map and sort results by distance. Location access is always optional — you can decline the permission prompt, or turn it off at any time in your device's Settings, without losing the ability to search or book manually. If location access is off, the App simply can't sort or center the map by your position.

We don't use your location for anything beyond powering this nearby-artist search, and we don't sell it. See "Location information" in our Privacy Policy for how it's stored and shared.

4. Booking Appointments

If you're a client

MUAH is a marketplace that connects you with independent makeup and hair artists — we don't employ artists and we're not a party to the beauty services you book. When you request a booking, you're entering into an agreement directly with that artist for the service, price, date, and time shown at checkout.

Where online payment is enabled for a booking, your payment is processed securely by Stripe. Canceling an appointment in the App updates its status to "Cancelled," but cancellation windows, rescheduling, and refunds are handled case-by-case between you, the artist, and MUAH support — reach out through our Contact page if you need help with a specific booking.

If you're an artist

You're responsible for the accuracy of your service menu, pricing, availability, and portfolio, and for holding any license, certification, or insurance required in your area to legally perform the services you list. You're an independent business using MUAH to find clients — nothing in these Terms makes you an employee, partner, or agent of MUAH.

Payout requests you submit (such as a PayPal email or bank details) are used solely to send you funds owed for completed bookings. Double-check that information before submitting a request — MUAH isn't responsible for payouts sent to an incorrect destination you provided.

MUAH does not currently charge clients a separate booking fee on top of your listed price, but we reserve the right to introduce service or payment-processing fees in the future, with notice.

5. Messages, Reviews & Community Content

Direct messages, Creative Circle posts and comments, reviews, and any photos you upload are your content, and you're responsible for it. By posting or sending it through the Services, you give MUAH a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute that content solely to operate and improve the Services (for example, showing your portfolio on your profile, or a review under an artist's Reviews tab).

Reviews should reflect your genuine experience. You agree not to post content that:

Is false, defamatory, harassing, hateful, or threatening
Infringes someone else's copyright, trademark, or other rights
Contains another person's private information without their consent
Promotes illegal activity, or content unrelated to beauty services and community
Includes malware, spam, or attempts to scrape or misuse the Services

We may remove content or suspend accounts that violate this section, though we don't proactively monitor every message or post.

6. Acceptable Use

In addition to Section 5, you agree not to:

Impersonate another person or misrepresent your affiliation with anyone
Use the Services to harass, stalk, or endanger another user
Circumvent booking or payment flows to avoid fees you agreed to
Attempt to gain unauthorized access to other accounts or to MUAH's systems
Use automated tools to scrape, copy, or bulk-download content from the Services

7. Intellectual Property

The MUAH name, logo, and the Site and App's design, code, and branding belong to MUAH and are protected by copyright, trademark, and other laws. These Terms don't grant you any right to use MUAH's branding except as necessary to use the Services normally. Artist portfolios, client reviews, and other user content remain owned by the person who posted them, subject to the license in Section 5.

8. Third-Party Services

The Services rely on third parties to operate — including Google Firebase for hosting, authentication, database, and storage, and Stripe for payment processing. Your use of payment features is also subject to Stripe's terms. We're not responsible for outages or issues caused by these third-party providers.

9. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied. MUAH doesn't guarantee that artists listed on the App are licensed, insured, or will meet your expectations, and we don't guarantee the availability, quality, or safety of any booked service. You're responsible for vetting an artist and communicating your needs before booking, just as you would with any independent contractor.

10. Limitation of Liability

To the fullest extent permitted by law, MUAH and its team won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, or from any service performed by an artist you booked through MUAH. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid MUAH in the 12 months before the claim, or (b) $100.

11. Indemnification

You agree to defend and hold MUAH harmless from any claim or demand — including reasonable legal fees — arising out of your use of the Services, your content, or your violation of these Terms.

12. Suspension & Termination

You can stop using the Services and request account deletion at any time by contacting us. We may suspend or terminate your access if we believe you've violated these Terms, misused the Services, or created risk or legal exposure for MUAH or other users.

13. Governing Law

These Terms are governed by the laws of [State/Country to be confirmed], without regard to conflict-of-law principles. Any dispute not resolved informally will be handled in the courts located in that jurisdiction, unless applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms as the Services evolve. We'll update the "Last updated" date above when we do, and material changes will be noted in the App or Site. Continuing to use the Services after changes take effect means you accept the updated Terms.
